Abstract

This study aims to examine the legal challenges arising from the application of the reverse burden of proof to assets related to narcotics offenses from the perspective of the presumption of innocence. The research is based on the tension between the state's interest in confiscating and recovering proceeds of narcotics-related crimes and the need to safeguard defendants' fundamental rights. The study employs normative legal research using statutory, conceptual, and case approaches. The legal materials were analyzed qualitatively through legal interpretation and synchronization of regulations governing narcotics offenses, evidentiary procedures, asset confiscation, and the presumption of innocence. The findings indicate that the application of the reverse burden of proof may serve as an effective legal instrument for combating narcotics crimes and facilitating asset recovery. However, its implementation may create a potential shift in the burden of proof to the defendant and consequently raise concerns regarding the protection of procedural rights. Therefore, the application of reverse burden mechanisms must remain limited, proportionate, transparent, and subject to judicial scrutiny. The study concludes that an appropriate balance must be maintained between the effectiveness of narcotics law enforcement and the protection of defendants' rights. Such balance can be achieved through a limited and proportionate reverse burden of proof mechanism that remains consistent with the presumption of innocence and the principles of due process of law.
