Protection of Personal Data in Criminal Press Releases: Study on Public Information Disclosure at the Padangsidimpuan Police Resort

This research is a study of the protection of personal data in the information release of terrorist criminals by the padangsidimpuan police resort based on the literature related to the issue at hand and various regulations. This study uses normative legal research with statute approach and conceptual approach by conducting review to the Law on Public Information Disclosure, the Press Law, the PDP Law, and the issuance of press release in some official police websites. Results: it is demonstrated that press releases on criminal will become an instrument of disclosure of public information and accountability of police performance, but the identity or personal attributes, or some specific information of suspects, victims, and related persons, should be restricted sufficiently. Such restrictions are imperative in order that public information disclosure will not be transformed into the invasion of privacy and life or personal data protection. This study suggests that the balance between public information disclosure, freedom of the press, and protection of personal data should be based on the philosophy of selectivity, data minimization, and consequence testing. Therefore, criminal press releases may continue to serve its informative and accountable purposes without compromising the dignity and rights of the subjects of personal data.
